A Freehold title, known as Hak Milik in Indonesia, is the most secure and comprehensive ownership title available. Bali freehold properties can only be owned by Indonesian citizens or legal entities entirely controlled by Indonesian nationals. However, foreign investors with a valid KITAS (residential visa permit) can acquire property using a Hak Pakai (Right to Use) structure, offering a legal and government-approved alternative.
What is Hak Pakai?
Hak Pakai is a legal mechanism that allows foreigners to obtain exclusive usage rights over Hak Milik land in Indonesia. This right is registered under a separate certificate in the name of the foreign buyer. It permits the holder to use the land for residential purposes and, subject to permits, construct buildings on it.
The Hak Pakai certificate is initially valid for 25 years and can be extended or renewed, providing long-term security for foreign property investors.
